Waiver of Liability Agreement
By submitting annual dues, the member listed in this application and their family ("Participating Family") agree to this liability release and covenant not to sue as described below:
RELEASE AND COVENANT NOT TO SUE
In anticipation of Participating Family's participation in ARCH activities (including, but not limited to sporting events, field trips, parties, picnics, classes, conferences, etc.). Participating Family (and each individual family member) does release, acquit, covenant not sue and forever discharge ARCH, its directors, officers, employees, successors, and assigns from any and all actions, causes of action, claims, demands, damages, costs, loss of services, expenses, compensation, and all consequential damage on account of, or in any way arising out of, any damages, including but not limited to injury or death arising occurring any time during the time Participating Family is engaged in ARCH related activities whether caused by the negligence of ARCH or otherwise.
Participating Family (and each individual family member) agrees to indemnify and save and hold harmless ARCH, its officers, employees, successors, and assigns from any and all actions, causes of action, claims, demands, damages, costs (including reasonable attorney fees), loss of services, expenses, compensation, and all consequential damages caused by Participating Family's (or individual family member's) breach of this agreement.
ARCH Sick Policy
By submitting annual dues, the member agrees to the following:
- Members shall not themselves attend or to knowingly allow their family members to attend an ARCH activity if the person:
a) has been running a fever within the last 24 hours
b) has been sick with vomiting or diarrhea within the last 24 hours
c) has a contagious illness or disease -- refrain from attending until the condition is no longer a risk to others as determined by your physician
- If illness occurs while at an ARCH activity and the parent or adult responsible for the child is on site, the parent or adult will be asked to take the child home promptly. If the parent is offsite, he or she will be contacted and asked to pick up the child promptly.
- If one or more family members are sick the well family members (showing no symptoms) are welcome to attend ARCH events except as limited by Item 4 below
- If a member knows that a family member has been exposed to a significant, contagious Illness and is in the incubation period for that illness, he or she should not allow the family member to attend any ARCH event until the incubation period is over, even if the exposed person is not showing any symptoms of the illness.
